TERMS AND CONDITIONS

INTRODUCTION

These Terms and Conditions govern the use of the OnMusic.fm website and define the terms for purchasing and filing complaints regarding licensed music sets for public playback.

AGREEMENT FORMATION

A contract between the Buyer and the Seller can be established in one of two ways:

  1. The Buyer has the right to negotiate any contractual terms before placing an order, including modifications to these terms.
    • Such negotiations must be conducted in written form and addressed to the Seller at:

  2. If the Buyer waives their right to negotiate, these Terms & Conditions apply in full, along with the relevant legal provisions.

§1. DEFINITIONS & CONTACT INFORMATION

  1. Postal Address – Full name or company name, location details (including street, number, zip code, and city).
  2. Complaint Address:

  3. Delivery Price List – Found under the “DELIVERY” section of the website.

  6. Proof of Purchase – Invoice, receipt, or bill confirming the transaction.
  7. Product Card – A detailed subpage describing a product or package.
  8. Client – An adult individual, legal entity, or business entity making a purchase.
  9. Consumer Rights Law – The Consumer Rights Act 2014 and EU Directive 2011/83/EU.
  10. Music License – A digital or physical license allowing legal public playback.

§2. GENERAL CONDITIONS

  1. The agreement is executed in English/Polish/French and is subject to EU law and local regulations.
  2. The place of product delivery must be within the European Economic Area (EEA).
  3. The Seller guarantees that all music offered is free from obligations to Collective Management Organizations (CMOs).
  4. All prices are in Polish Zloty (PLN) and are exclusive of VAT (23%).
  5. The Seller does not charge any additional fees for online communication.

§3. ONMUSIC.FM SERVICES

  1. OnMusic.fm provides custom music stations for businesses with a valid license.
  2. The Buyer receives access credentials & a digital license within 10 business days of payment.
  3. The Seller reserves the right to modify prices, promotions, and offers.

§4. AGREEMENT FORMATION & ORDER FULFILLMENT

  1. Orders can be placed via:
  2. Orders can be placed 24/7, but telephone support is available only during business hours.
  3. Orders are confirmed via email.
  4. Delivery occurs via:
    • Download link (for digital content)
    • Physical USB drive (on request, additional fee applies)

§5. LICENSE COMMENCEMENT

  • The license is valid upon receipt of payment and confirmation from the Seller.

§6. LICENSE EXPIRY

  • Lifetime License: Permanent validity, independent of Seller’s business status.
  • Fixed-Term License: Valid for a specific period, as stated in the license document.

§7. RIGHT OF WITHDRAWAL

1. Withdrawal Policy (14 Days)

  • Under EU Consumer Rights Law, a Buyer may withdraw from the contract within 14 days of receiving the product.

2. Exclusions from Withdrawal:

  • The right of withdrawal does not apply to:
    • Digital music files (once downloaded).
    • CDs/DVDs if their security seal is removed.

3. How to Withdraw

  • Refunds will be processed within 5 business days after receiving the returned product.

§8. COMPLAINTS & DISPUTE RESOLUTION

  1. Complaints should be submitted in writing to office@onmusic.fm or via mail.
  2. The Seller must respond to complaints within 14 calendar days.
  3. If a resolution is not satisfactory, the Buyer may contact:
    • European Consumer Centres Network (ECC-Net)
    • Local Consumer Protection Authorities

§9. FINAL PROVISIONS

  1. These Terms do not override consumer rights laws.
  2. Any modifications to these Terms & Conditions will be communicated 30 days in advance.
  3. All legal disputes will be settled by a competent European court.
  4. If any provision is found invalid, it will be replaced by a legally acceptable equivalent.
